The presidential announcement for transferring powers and forming a presidential leadership council has been issued today. It states “

President of the Republic:

Based on the powers granted to me, in accordance with the Constitution of the Republic of Yemen in embodying the people’s will, respecting the constitution and law, protecting national unity, the principles and objectives of the Yemeni revolution, committing to the peaceful transfer of power and supervising the sovereign tasks related to the defense of the Republic and those related to the foreign policy of the state;

And based on the Gulf initiative and its executive mechanism;

And in accordance with Article 9 of the executive mechanism of the Gulf initiative, which stipulates the need to take all necessary legislation to implement the guarantees contained in the Gulf initiative, the most important of which is meeting the aspirations of our people for change and reform, and removing the elements of political and security tension;

Based on my capacity as the President of the Republic of Yemen, the desire to involve effective leaders in managing the state in this transitional period, affirming our commitment to Yemen’s unity, sovereignty, independence, and territorial integrity, considering the historical, national and humanitarian responsibility in the current circumstances that the country is going through in all its lands, confronting humanitarian and political crises that resulted from the wars among our people, overcoming the difficulties and obstacles that were placed in the way of achieving our people’s aspirations to build a new Yemen,  achieving the requirements of our people in preserving the social integrity, stopping the bloodshed, healing the wounds, embodying the goals of the glorious September and October revolutions, preserving the unity of our people in civil state that achieves broad partnership and equitable distribution of wealth, protects everyone, achieving the essence of the outcomes of the Comprehensive National Dialogue, keeping to preserve the bonds of brotherhood among all our people, based on the principles that our people believe in, the need to achieve their aspirations for a comprehensive and lasting peace, preserving the security of all citizens and stability of the security of the homeland and the integrity of its territory, continuing the tasks of the transitional period and implementing the consensus of our honorable people;

 

We announced the declaration of transferring powers as follows:

Article 1: The Presidential Leadership Council.

(A): Pursuant to this declaration, a Presidential Leadership Council shall be established to complete the implementation of the tasks of the transitional period, and I hereby I irreversibly delegate to the Presidential Leadership Council my full powers in accordance with the constitution and the Gulf Initiative and its executive mechanism,"

  (B): The Presidential Leadership Council, in addition to its above-mentioned powers, shall have all the powers of the Vice President.

(C): The Presidential Leadership Council will be chaired by Rashad Mohammed Al-Alimi, and the membership of seven members are:

(1) Sultan Ali Al-Arada.

(2) Tariq Mohammed Saleh.

(3) Abd al-Rahman Abu Zara’a.

(4) Abdullah Al-Alimi Bawazeer.

(5) Othman Hussein Mogali.

(6) Aidarous Qassem Al-Zubaidi.

(7) Faraj Salmin Al-Bahsani.

(D): Each member of the Presidential Leadership Council shall have the rank of Deputy Chairman of the Presidential Leadership Council.

(E): The President and members of the Presidential Leadership Council shall abide by the principle of collective responsibility and strive to achieve the highest degree of consensus among them.

(F): The Presidential Leadership Council shall have the following competencies:

 

1) Managing the country politically, militarily and security throughout the transitional period.

2) Adopting a balanced foreign policy that achieves the supreme national interests of the State based on the basis of independence and common interests in a manner that preserves the sovereignty, security and borders of the State.

3) Facilitating the government's exercise of its responsibilities with its full powers throughout the transitional period.

4) Adopting the necessary policies to enhance security and combat terrorism throughout the Republic of Yemen.

5) Forming the joint security and military committee to achieve security and stability by adopting policies that would prevent any armed confrontations throughout the Republic, creating environment, taking necessary steps to achieve the integration of the armed forces under a unified national command structure within the framework of the rule of law, ending the armed forces division, addressing its causes, ending all armed conflicts, establishing a national doctrine for members of the army and security forces, and any tasks the Council deems to promote stability and security.

6) Enhancing equality among citizens in all rights, duties and achieving broad partnership.

(G): The President of the Presidential Leadership Council shall exclusively have the following powers and authorities:

(1) The Supreme Command of the Armed Forces.

(2) Representing the Republic at home and abroad.

(3) Appointing governors, security directors, Supreme Court judges and the governor of the Central Bank, after consulting with the Prime Minister, provided that the names are agreed upon with members of the Presidential Leadership Council, and in case of disagreement, the decision is presented according to the decision-making mechanism referred to in paragraph (k) of this article.

(4) Ratification of agreements that do not require ratification by the Council of Representatives after the approval of the Council of Ministers.

(5) Establishing of diplomatic missions, appointing and recalling ambassadors in accordance with the law.

(6) Calling the Council of Ministers to a joint meeting with the President of the Presidential Leadership Council whenever necessary.

(7) Declaring a state of emergency and general mobilization in accordance with the constitution and the law, unless the Presidential Leadership Council, by a two-thirds majority, decides not to declare.

8) Calling the regular and extraordinary sessions of the Presidential Leadership Council.

(H): Vacancies of the President and Members of the Presidential Leadership Council:

(1). In the event of the death, disability, or resignation of the President of the Presidential Leadership Council, the council is headed by the eldest member and continues as the council’s president unless the Presidential Leadership Council deems it necessary by consensus or by a two-thirds majority vote to elect another president of the council’s members.

(2).The rules governing the work of the Presidential Leadership Council shall deal with the death, incapacity or resignation of a member of the Council.

(I): The Chairman of the Presidential Leadership Council or his representative shall determine the place and time of the sessions in the calling addressed to the members. The session is held with the president or his representative and at least four members, taking into account the possibility of holding sessions virtually remotely for all or some of the members of the Presidential Leadership Council when necessary.

(J): No member of the Presidential Leadership Council may refuse to participate in council meetings except for reasons of death, disability, serious illness, or an urgent case that prevents him from attending. In the event that a member of the Council does not attend the Council meetings, his right to vote in the meeting in which he was absent shall forfeit.

(K): Decisions of the Presidential Leadership Council are issued by consensus, and in the event of inconsistency, the following shall be implemented:

(1). Decisions are taken upon voting by a simple majority, and in the event of a tie, the side voted for by the President of the Presidential Leadership Council shall prevail.

(2). If a simple majority is not present, the matter is referred to a joint meeting with the Presidency of the Consultation and Reconciliation Commission.

(3). Decisions are taken in the joint meeting of the Presidential Leadership Council and the Presidency of the Consultation and Reconciliation Commission by a simple majority of those present. When the votes are equal, the side for which the President of the Presidential Leadership Council voted shall prevail.

(4). If it is not possible to have a simple majority of the attendees at the joint meeting, the Chairman of the Presidential Leadership Council decides the decision.

(L): The President of the Presidential Leadership Council issues Republican decrees and decisions to implement the decisions of the Council within (24) hours after voting on the decision.

(M): The President of the Presidential Leadership Council approves the rules regulating the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team, and the economic team formed under this announcement within (15) days from the date of submitting the legal team’s recommendation of the draft organizing rules, and it is issued by law.

(N): The President of the Presidential Leadership Council decides the necessary executive procedures for the conduct of the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team and the economic team until the approval of the organizing rules.

Article 2: The Consultation and Reconciliation Commission.

(A): In accordance with this announcement, a body will be established that brings together the various components to support and assist the Presidential Leadership Council and work to unify and gather national forces in a way that enhances the efforts of the Presidential Leadership Council and create the appropriate environment to stop the fighting and conflicts between all forces and reach peace that achieves security and stability throughout the Republic.

(B): The commission works to unify the visions and objectives of the various national forces and components, in a way that contributes to restoring State institutions and consolidating Yemen's belonging to its Arab incubator.

(C): The Commission is composed of fifty members as follows:

(D): The Consultation and Reconciliation Commission elects its executive presidency from among its members in its first session, based on an invitation from the President of the Presidential Leadership Council. The presidency of the commission consists of a president and four deputies, provided that the first session of the commission is chaired by the president and members of the Presidential Leadership Council.

(E): The President of the Presidential Leadership Council is entitled to appoint whomever he deems fit to be a member of the Commission when needed, provided that the number of members does not exceed one hundred members.

Article 3: The legal team.

(A): A legal team of competent national competencies shall be formed to draft the rules regulating the work of the Presidential Leadership Council, the Consultation and Reconciliation Commission, the legal team and the economic team formed under this declaration, and it shall be submitted within (45) days from the date of this declaration to the President of the Presidential Leadership Council for approval and shall be issued by law. The team has the right to submit its advisory opinion on legislative and constitutional issues to the Presidential Leadership Council upon a request from the Council chairman.

(B): The team shall be headed by Ismail Ahmed Al-Wazir and the membership of each of the following:

(1) Ahmed Zabin Attia.

(2) Ahmed Arman.

(3) Ghaleb Abdul Kafi Al-Qurashi.

(4) Hamoud Abdel Hamid Al-Hitar.

(5) Abbas Mohammed Mohammed Zaid.

(6) Mohammed Saleh Ali.

(7) Mohammed Musa Al-Amiri.

(8) Nabila Mohammed Al-Hakimi.

(9) Nihal Al-Awlaki

(C): The President of the Presidential Leadership Council shall have the right to appoint whom he deems fit from the national competencies to join the team when needed.

(D): In the event of any member of the team’s apology, the President of the Presidential Leadership Council appoints another member. In the event the team leader apologizes, the members elect a leader among them within a period not exceeding (15) days. The President of the Presidential Leadership Council is entitled to appoint whomever he deems to be the team leader in the event that the election could not be made.

Article 4: the Economic Team.

(A): An economic team of competent national competencies is formed to support government reforms and provide advice and consultation to the government and the Central Bank regarding urgent reforms in the economic, development, financial and monetary fields. In addition to working to enhance efficiency, transparency and integrity in government agencies, analyzing economic challenges, working to develop the foundations for sustainable development, making the necessary plans for economic development, offering stimulating solutions for economic growth, working to increase State revenues, raising the efficiency of revenues, and diversifying the economic base. This team presents its opinion and studies to the Presidential Leadership Council regarding the State's general economic and financial issues.

(B): The team shall be chaired by Hussam Al-Sharjabi and the membership of each of the following:

(1) Ahmed Bazara.

(2) Jalal Yaqoub.

(3) Jihan Abdel Ghaffar.

(4) Raafat Al-Akhali.

(5) Sa’ad Sabra.

(6) Shawqi Hayel Saeed.

(7) Alaa Qassem.

(8) Othman Al-Haddi.

(9) Ali al-Habashi.

(10) Omar Al akil

(11) Fares Al-Jadabi.

(12) Mohammed Hammam.

(13) Mohammed Shehab.

(14) Najat Joma’an Amin.

(C): The President of the Presidential Leadership Council appoints whom he deems fit from the national competencies to join the team when needed.

(D): In the event of any member of the team’s apology, the President of the Presidential Leadership Council appoints another member. In the event the team leader apologizes, the members elect a leader among them within a period not exceeding (15) days. The President of the Presidential Leadership Council is entitled to appoint whomever he deems to be the team leader in the event that the election could not be made.

Article 5: The Representatives and the Shura Councils.

The mandates of the Representatives and the Shura Councils shall continue in their duties entrusted to them.

Article 6: The Technocracy Government.

This announcement renews confidence in the government formed under the Riyadh Agreement, at the same time the Presidential Leadership Council shall take what it deems to make amendments or changes in the government, or even form a new government according to its powers.

Article 7: a comprehensive political solution.

The Presidential Leadership Council is in charge of negotiating with (Ansar Allah) the Houthis for a permanent ceasefire throughout the Republic of Yemen and coming to the negotiating table to reach a final and comprehensive political solution that includes a transitional period that would move Yemen from a state of war to a state of peace.

Article 8: expiry of the Presidential Leadership Council's work.

The term of the Presidential Leadership Council ends in accordance with a comprehensive political solution and the establishment of complete peace throughout the Republic of Yemen, which includes defining the transitional period and its requirements, or when general elections are held in accordance with the new constitution and the inauguration of the new president of the republic.

Article 9: Inconsistency.

This declaration supersedes what contradicts its provisions in the constitution and laws.

The Saudi Crown Prince receives the President of the Yemeni Presidential Leadership Council and members of the Council

Saudi Crown Prince: We support the Yemeni Presidential Leadership Council and its aspirations to start a new phase in Yemen.. We are keen for Yemen to enjoy security and stability.

On Thursday, Saudi Crown Prince Mohammed bin Salman received the President of the Yemeni Presidential Leadership Council, Dr. Rashad Al-Alimi and members of the Council, where he expressed the Kingdom's support for the Council and its aspiration that its founding would contribute to the beginning of a new phase in Yemen that would move it from war to peace and development.

He also expressed his hope that the next stage will be different, noting the determination and optimism of all.

Prince Mohammed bin Salman expressed the Kingdom's keenness to ensure that Yemen enjoys security and stability.

The meeting was attended by Prince Khalid bin Salman bin Abdulaziz, Deputy Minister of Defense, Prince Faisal bin Farhan bin Abdullah, Minister of Foreign Affairs, Minister of State, Member of the Cabinet, National Security Adviser Dr. Musaed bin Mohammed Al-Aiban, Head of State Security Mr. Abdulaziz Al-Huwairini, Chief of General Intelligence Mr. Khalid Al-Humaidan, and Ambassador of the Custodian of the Two Holy Mosques in Yemen, Mr. Mohammed Al Jaber.

The Yemeni President Abd Rabbo Mansour Hadi issued, at dawn today, Thursday, a decision to form a presidential leadership council that all the President’s powers shall be transferred to it in accordance with the constitution, the Gulf initiative and its executive mechanism. The President also issued a decision to relieve his deputy, Ali Mohsen al-Ahmar, from his position.

The presidential statement stated that the new presidential leadership council in Yemen shall take over the political, military and security management of the country throughout the transitional period.
